प्रदेश में भूमि पूलिंग नियमावली 2025 को कैबिनेट ने मंजूरी दे दी। जमीन के बदले विकसित जमीन और मालिक को आजीविका भत्ता भी सरकार देगी।

उत्तराखंड सरकार अब सुनियोजित शहरी विकास को बढ़ावा देने के लिए जमीन के बदले विकसित जमीन और मालिक को आजीविका भत्ता भी देगी। बुधवार को धामी कैबिनेट ने भूमि पूलिंग नियमावली 2025 पर मुहर लगा दी। इसके तहत जमीन लेकर प्राधिकरण विकसित करेंगे। उसका एक हिस्सा मालिक को लौटा देंगे और बाकी को बेचा जा सकेगा।

अभी तक प्रदेश में भूमि अधिग्रहण की जो परंपरागत प्रक्रिया है, उसकी जगह भूमि पूलिंग से साझेदारी आधारित विकास मॉडल तैयार होगा। इसमें जमीन का मालिक अपनी जमीन देकर बदले में विकसित प्लॉट और आर्थिक लाभ ले सकेंगे। इस नीति के तहत भूमि मालिक स्वेच्छा से अपनी भूमि को सरकार या प्राधिकरण को विकास के लिए सौंपेंगे।

विकसित होने के बाद, उन्हें भूमि का एक निर्धारित हिस्सा रिहायशी और व्यावसायिक प्लॉटों के रूप में वापस दिया जाएगा। बची जमीन को प्राधिकरण लीज पर दे सकेंगे या फिर बेच भी सकेंगे। प्रमुख सचिव आवास आर मीनाक्षी सुंदरम ने बताया कि इससे प्रदेश में शहरीकरण को बढ़ावा मिलेगा। प्राधिकरण जमीन को लेकर विकसित करेंगे। इसका मकसद लाभ कमाना नहीं बल्कि सुनियोजित विकास को बढ़ावा देना है।

जमीन ही नहीं पैसा भी मिलेगा

-जिन लोगों के नाम जमीन है, उन्हें उनकी जमीन में से 24 प्रतिशत तक विकसित रिहायशी प्लॉट, सात प्रतिशत विकसित कॉमर्शियल प्लॉट मिलेगा। कॉमर्शियल प्लॉट न लेने पर 14 प्रतिशत अतिरिक्त रिहायशी प्लॉट मिलेंगे। साथ ही विकसित प्लॉट न देने की स्थिति में रिहायशी प्लॉट पर दोगुना, कॉमर्शियल प्लॉट पर तीन गुना सर्किल रेट के बराबर राशि मिलेगी।

-ऐसी जमीन, जिसे कानूनी तौर पर किसी अन्य के नाम नहीं किया जा सकता, उनके मालिकों को जमीन विकसित कराने की सूरत में 22 प्रतिशत रिहायशी और छह प्रतिशत कॉमर्शियल जमीन मिलेगी।

-इन सभी को गैर कृषि भूमि होने पर 12 रुपये प्रति वर्ग मीटर प्रतिमाह, कृषि भूमि होने पर छह रुपये प्रति वर्ग मीटर प्रतिमाह आजीविका भत्ता मिलेगा। यह अधिकतम तीन साल तक दिया जाएगा, जिसका भुगतान तीन वार्षिक किस्तों में होगा। इसका अग्रिम भुगतान 25-30 प्रतिशत किया जाएगा।

-छोटे भूमि मालिकों को 250 वर्गमीटर से कम भूमि होने पर सर्किल रेट के हिसाब सो नकद मुआवजा मिलेगा।

-योजना के तहत सूचना जारी होने से लेकर अंतिम प्रमाणपत्र तक 13 चरण तय किए गए हैं। 90 दिन में बेस मैप व ड्राफ्ट लेआउट तैयार होगा। 15 दिन में आपत्तियों की सुनवाई होगी। अंतिम लेआउट का प्रकाश 15 दिन में होगा। अधिग्रहित भूमि का हस्तांतरण 30 दिनों में होगा। सभी रिकॉर्ड अपडेट करने और पुनर्गठित प्लॉट जारी करने की जिम्मेदारी प्राधिकरण की होगी।

विकास पर अस्थायी रोक लगेगी

भूमि पूलिंग योजना घोषित होते ही उस क्षेत्र में दो वर्षों के लिए निर्माण प्रतिबंध लागू होगा, जिसे 6-12 महीने और बढ़ाया जा सकता है। भूमि मालिक से सरकार एवं सरकार से भूमि मालिक को पुनर्गठित प्लॉट वापस देने पर कोई स्टांप ड्यूटी या रजिस्ट्रेशन शुल्क नहीं लगेगा। उत्तराखंड आवास एवं नगर विकास प्राधिकरण के संयुक्त मुख्य प्रशासक डीपी सिंह ने बताया कि इस योजना के तहत किसी विवाद की स्थिति में तीन स्तरीय अपील प्रणाली होगी, जिसके तहत पहला स्तर प्राधिकरण के चेयरमैन का होगा। दूसरा स्तर उत्तराखंड आवास विकास प्राधिकरण के मुख्य प्रशासक का होगा और तीसरा स्तर इंफ्रास्ट्रक्चर डेवलपमेंट कमिश्नर का होगा, जिनका निर्णय अंतिम होगा।

इन राज्यों में सफल हुई पूलिंग नीति

आंध्र प्रदेश में अमरावती विकास के लिए एपीसीआरडीए के तहत लगभग 33,000 एकड़ भूमि पूल की गई, जिसने 51,000 करोड़ के नियोजित निवेश को आकर्षित किया। दिल्ली में भूमि पूलिंग नीति के तहत शहरी विस्तार के लिए लगभग 20,000 हेक्टेयर भूमि को अधिसूचित किया गया, जिससे 60,000 करोड़ से अधिक निजी निवेश मिलेगा।
